Cash Bail: Time for Reform?



If you have never been arrested and held in a local detention facility, you may have limited knowledge of our nation’s cash bail release process. You may wonder why the U.S. and the Philippines are the only two countries to have such a practice. We will review the history of bail and discuss its purpose and the process through which bail is assigned. We will review North Carolina general statute requirements, examine who actually pays bail, and discuss the reach of the for-profit bail industry and its impact. Finally, we will consider how risk is assessed in determining release conditions and review reform efforts nationally and in North Carolina.
